1. Acceptance of Terms

By using our website or submitting an application for verification, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions, as well as our Privacy Policy and Disclaimer. If you do not agree with any part of these terms, you must not use our services.

2. Nature of Ritmark Verification

Ritmark is a private, independent verification authority. We are not a government body, regulator, or statutory authority. Our verification is a voluntary certification that reflects our assessment of a brand's compliance with our 9-pillar standards at the time of audit. This certification does not replace or exempt brands from any legal, regulatory, or statutory requirements (including but not limited to FSSAI, Ayush, BIS, or GST compliance).

3. Eligibility & Application Process

• Eligibility: Any brand that is 100% Indian-owned and manufactures products in India is eligible to apply. Brands must operate in good faith and provide truthful information.
• Application: Applicants must complete the online application form and provide all requested documentation, including ingredient decks, manufacturing details, and ownership proof.
• Review: Ritmark will review the application and conduct a rigorous audit. We may request additional information or clarifications during this process.
• Decision: Ritmark reserves the sole discretion to approve, conditionally approve, or reject any application. We are not obligated to provide a reason for rejection.

4. Honesty & Accuracy Clause

All information provided by the applicant must be accurate, complete, and truthful. Any misrepresentation, omission, or falsification of information will result in immediate rejection of the application. If such misrepresentation is discovered after verification has been granted, the verification will be immediately revoked and the brand may be publicly disqualified.

5. The Ritmark Mark & Intellectual Property

• Ownership: The Ritmark logo, name, seal, and all associated intellectual property are the exclusive property of Ritmark Verification Authority. All rights are reserved.
• License: Upon successful verification, Ritmark grants the brand a revocable, non-transferable, limited license to display the Ritmark seal on verified products and marketing materials for the duration of the verification.
• Restrictions: The license does not permit any modification, alteration, or misuse of the Ritmark mark. The mark must be displayed as provided by Ritmark and must not be used in any way that could mislead consumers or damage the reputation of Ritmark.
• Revocation: Ritmark reserves the right to revoke this license at any time, with or without cause, including but not limited to non-compliance, quality issues, consumer complaints, or violation of these terms.

6. Right to Revoke Verification

Ritmark retains the unconditional right to revoke a brand's verification at any time, for any reason, including but not limited to:

• Failure to maintain the 9-pillar standards.
• Consumer complaints or negative feedback regarding product quality or safety.
• Changes in ownership, manufacturing, or ingredients that affect compliance.
• Violation of these Terms & Conditions or any applicable law.
• Conduct that, in Ritmark's sole opinion, damages the reputation or integrity of the Ritmark mark.

In the event of revocation, the brand must immediately cease all use of the Ritmark mark and remove it from all products, packaging, and marketing materials.

7. Fees & Payments

Ritmark may charge a verification fee for processing applications, conducting audits, and maintaining the verified brand directory. Fees are subject to change and will be communicated to applicants prior to payment. All fees are non-refundable, except as otherwise stated in writing.

8. Limitation of Liability

To the fullest extent permitted by law, Ritmark Verification Authority, its directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to:

• Your use of our website or services.
• Any verification decision, approval, or rejection.
• Any product-related issues, including but not limited to consumer reactions, safety concerns, or business losses.
• Any errors, omissions, or inaccuracies in the verification process.

In no event shall our total liability exceed the fees paid by you to Ritmark in the preceding 12 months.

9. Indemnification

You agree to indemnify, defend, and hold harmless Ritmark Verification Authority and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or related to:

• Your breach of these Terms & Conditions.
• Your violation of any applicable law or regulation.
• Your use or misuse of the Ritmark mark.
• Any product liability or consumer claim related to your products.

10. Dispute Resolution

Any dispute arising out of or relating to these Terms & Conditions or your use of our services shall be governed by the laws of India. The parties agree to first attempt to resolve the dispute through good-faith negotiations. If the dispute cannot be resolved amicably, it shall be submitted to binding arbitration in Kachchh, Gujarat, India, in accordance with the Arbitration and Conciliation Act, 1996. The decision of the arbitrator shall be final and binding on both parties.

11. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law provisions. The courts of Kachchh, Gujarat shall have exclusive jurisdiction over any disputes.

12. Severability

If any provision of these Terms & Conditions is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Ritmark reserves the right to update or modify these Terms & Conditions at any time without prior notice. Changes will be effective immediately upon posting on this page. Your continued use of our services after any changes constitutes your acceptance of the new terms.

• BIS (Bureau of Indian Standards) certifications.
• GST and other tax compliance.

Ritmark does not assume any responsibility for a brand's compliance with these or any other statutory requirements.

2. No Warranty or Guarantee

Ritmark provides its services on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding:

• The accuracy, completeness, or reliability of any information provided on our website or through our services.
• The safety, quality, or efficacy of any verified product.
• The continued compliance of any verified brand after the audit date.
• The availability or uninterrupted operation of our website or services.

To the fullest extent permitted by law, Ritmark disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

3. Limitation of Liability

In no event shall Ritmark Verification Authority, its directors, officers, employees, agents, or affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to:

• Maintaining the standards that were verified by Ritmark.

Ritmark does not assume any liability for the actions or omissions of verified brands.
